What documents do you need to sell a house in Mallorca?

If you want to sell your house in Mallorca, then you should take care of a few documents that you need for this at an early stage.

Spanish tax number

The owner of the property must present the National Identity Card (DNI) or NIE in the case of foreigners so that ownership of the property can be verified.

Land register extract

One of the most important documents is the extract from the land register. This allows you to prove that you are the owner and whether there are any registered encumbrances such as mortgages, rights of way, tenants etc.

Cadastre

The extract from the cadastre is also important. The so-called simple cadastral extract can be obtained online. As for plot size and boundaries and other facts, don’t get confused because sometimes these details don’t match what’s in the land registry. Especially with rustic properties, there are often differences in square meters and property boundaries. Therefore, it makes sense that a topographer draws up an accurate plan to determine these. When selling, this data should be updated so that the land register and cadastre correspond to each other.

City Waste Tax

This is the amount to be paid for the collection and disposal of municipal solid waste. Each municipality determines what waste fee it deems appropriate, which therefore varies from municipality to municipality.

Habitability Certificate

Anyone who sells, rents out or lets others use their property must provide a copy of the valid certificate of habitability. If it is missing, this must be made clear in the contract or in the document. You also need a certificate of habitability for contracts with the various utility companies, for example for electricity, gas, water or telecommunications, and last but not least if you want to officially register your property for tourist rentals.

Energy pass

Since 2013, when you sell your property, you need an energy efficiency certificate, which you can have prepared by an authorized technician.

IBI (Annual Council Tax)

Receipt of property tax paid to the municipality (IBI: impuesto sobre bienes inmuebles) and receipt of fee paid for waste disposal, both from the last four years. Include the last bills that you have paid for water, electricity, gas etc. and the building ledger.

Coastal Demarcation Law

Do you enjoy the luxury of having your property near the sea? Then you must have a certificate from the Coastal Authority that your home is not covered by the 1988 Coastal Act. The coastal strip from the sea up to 10 meters is also so-called public-communal maritime property. Especially if your house is in this area, the certificate is necessary.

So you see: Selling your property involves bureaucracy. Because once a buyer is in sight and you are missing important documents, time problems can quickly arise or the prospective buyer loses interest.
